After filing a complaint through proxy on behalf of a number of residents of the South who were displaced due to the recent war, and after his promise to the Lebanese people to begin reviewing all files within the Lebanese administration and confronting the corruption and dysfunction prevailing in the state, the Legal Activities Group, led by Attorney Elie Mahfoud, in cooperation and partnership with a group of lawyers, on 4/3/2024, filed a complaint to the Central Inspection Office, objecting to the dysfunctionality in the General Directorate of Civil Aviation at Rafic Hariri International Airport.
Accordingly
the complaint focused on:
A) Violating the Lebanese Constitution, which affirms the principle of parity
Especially:
•Article 7: All Lebanese shall be equal before the law. They shall equally enjoy civil and political rights and shall equally be bound by public obligations and duties without any distinction.
•Article 12: Every Lebanese shall have the right to hold public office; no preference shall be made except on the basis of merit and competence, according to the conditions established by law. A special statute shall guarantee the rights of civil servants in the departments to which they belong.
•Article 95: The Parliament, elected on the basis of parity between Muslims and Christians, shall take the appropriate measures to abolish political sectarianism, according to an interim plan, and the formation of a National Council headed by the President of the Republic consisting, in addition to the Parliament Speaker and the Prime Minister, as well as political, intellectual, and social figures.
B) Violating Legislative Decree No. 112 dated 6/12/1959, as Article 12 thereof stipulates the following:
Vacant positions in the first category shall be filled by selection from among the employees of the three highest grades of the second category listed in the promotion schedule. They shall be classified in the last grade of the first category, and shall retain their right to qualify for promotion if they are classified with a salary equivalent to theirs.
"Employees of the first category shall be appointed by decree issued by the Council of Ministers."
C) Dysfunctionality in the General Directorate of Civil Aviation in Lebanon
A large number of employees have been replaced from outside the doctrine of employees who retired or left the service due to retirement or for personal reasons.
In conclusion
The Legal Activities Group directly requested appropriate investigation, preparing the report, and submitting it to the competent authorities to take judicial and procedural actions against anyone proven to be involved, participating in, or covering up this serious constitutional violation, in accordance with Article 95 of the Constitution, as well as the principles and rules of the National Pact and the National Reconciliation Accord. This aims at nullifying all arbitrary appointments and violations of the Constitution and the law, and restoring matters to their constitutional framework to ensure coexistence in Lebanon.
It is noted that numerous extensive and diversified files concerning administrative and functional sluggishness, as well as all matters related to corruption and wastage, will be the focal point of legal proceedings within Lebanon and also within international courts. It is worth mentioning that Mahfoud has previously pursued legal actions on several sensitive and intricate files. Will the investigations in these matters yield results?
It was noted that numerous extensive and diversified files concerning administrative and functional slacking, as well as all the matters related to corruption and waste will be the focal point of legal proceedings within Lebanon and also within international courts.
It is noteworthy here that Mahfoud has previously carried out judicial activity regarding a number of sensitive and delicate files. Therefore, will investigating them reach results?
